Imonggo Partner Agreement

These terms and conditions pertain to an individual and/or company's participation in the Imonggo.com Affiliate program, aka Imonggo Partner Program.

UPON CHECKING THE "I ACCEPT" BOX SHOWN AS PART OF THE APPLICATION PROCESS, YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS AND POLICIES (THE "AGREEMENT") GOVERNING YOUR USE OF IMONGGO.COM'S ONLINE SERVICE. IF YOU ACCEPT THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU ARE AUTHORIZED TO BIND THIS COMPANY TO THESE TERMS AND CONDITIONS, IN WHICH CASE THE TERMS "YOU" OR "YOUR" SHALL REFER TO THIS COMPANY. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MUST LEAVE THE "I ACCEPT" BOX BLANK AND YOU SHOULD NOT PROCEED WITH THE APPLICATION PROCESS.

1. Joining the Program

Your participation in the program is solely for this purpose: to legally advertise the Imonggo site and receive a commission based on products and services purchased by your referred individuals.

Your affiliate application and status in the program may be suspended or terminated for any of the following reasons:

3. Linking to Imonggo.com

You may use graphic and text links both on your Web site and in emails. The site may also be advertised "offline" in classified ads, magazines, and newspapers. You may use the graphics and text provided to you by Imonggo.com, or you may create your own as long as they are deemed appropriate according to the conditions in section 2 of this document.

4. Affiliate Commissions

Your direct partners refer to Imonggo partners directly referred by you. Your indirect partners refer to Imonggo partners referred by your direct partners.

You will be paid 10% of the subscription amount for every premium account directly generated by your hyperlinks. You will also be paid a 10% commission based on the earnings of your direct partners; and another 10% commission based on the earnings of the your indirect partners. You will NOT receive affiliate commission on products or services bought by yourself or your company.

You will earn a corresponding amount of commissions every month for as long as the premium account owners referred by you or your direct and indirect partners continue to subscribe and pay Imonggo.com the premium subscription fee.

Affiliate commissions will be paid out upon your request and when commission balance reaches the minimum value of US$30. If the referred product or service was refunded, money was reimbursed or credit card charge backs occurred, Imonggo.com has the right to deduct the appropriate commissions.

5. Trademark

Imonggo.com reserves all rights in or to its trademarks but may be used by Affiliate in accordance with this agreement. Affiliate may in no way display an Imonggo related logo, image, or trademark which may be distasteful, defaming, or misrepresenting of its brand. Imonggo has the right to specify how and if a trademark may be used by the Affiliate.

6. Terms of the agreement

These terms will begin upon your signup with the affiliate program and will end when either you or Imonggo.com terminates your affiliate status. The terms of this agreement may be modified at any time by Imonggo.com. If any modification is unacceptable to you, your only choice is to terminate your affiliate status. Your continuing participation in the program will constitute your acceptance of any change.

7. Independent Contractor

The relationship between Imonggo and Affiliate established by this Agreement is that of independent contractors. Imonggo and Affiliates shall each conduct its respective business at its own initiative, responsibility and expense, and shall have no authority to incur any obligations on behalf of the other, except as otherwise provided herein.

8. Liability

Imonggo.com will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of "intents of harm" to the program. Imonggo.com does not make any expressed or implied warranties with respect to the affiliate program and/or products sold at this site. We make no claim that the operation of Imonggo.com will be error-free and will not be liable for any interruptions or errors.

9. Taxation

You will be acting in an independent contractor capacity and are responsible for any and all taxes due from income resulting from your affiliation with Imonggo.com
